Acceptance of Terms
By accessing or using the Wingo platform ("Platform", "we", "us", or "our"), creating an account, or participating in any challenge, you ("User", "you", or "your") agree to be bound by these Terms & Conditions ("Terms") in their entirety.
If you do not agree with any part of these Terms, you must immediately stop using the Platform and must not participate in any challenges. Your continued use of the Platform following any modifications constitutes your acceptance of the revised Terms.
These Terms should be read in conjunction with our Privacy Policy and Refund Policy, all of which are incorporated herein by reference.
Eligibility
To participate in challenges on Wingo, you must meet all of the following eligibility requirements:
- You must be at least 18 years of age at the time of registration. Wingo strictly prohibits participation by minors.
- You must be a resident of Sri Lanka with a valid national identity card (NIC) or passport.
- You must possess a valid and active bank account or supported digital payment method registered in your name for prize disbursement.
- You must not be an employee, director, officer, agent, or contractor of Wingo or any of its affiliates, subsidiaries, or service providers.
- You must not have been previously banned, suspended, or permanently removed from the Platform.
- You must be legally capable of entering into binding contracts under the laws of Sri Lanka.
- You must hold only one (1) account per person. Multiple accounts are strictly prohibited.
Wingo may modify eligibility requirements at any time without prior notice. If you no longer meet the eligibility requirements, you must cease participation immediately.
Account Registration
To participate in challenges, you are required to create an account on the Platform. By registering, you agree to:
- Provide accurate, current, and complete information during registration, including your full legal name, date of birth, valid email address, Sri Lankan mobile number, and national identity card (NIC) number.
- Maintain and promptly update your account information to keep it accurate, current, and complete.
- Keep your login credentials (username and password) strictly confidential and not share them with any third party.
- Notify Wingo immediately upon becoming aware of any unauthorized use of your account or any other breach of security.
- Accept full responsibility for all activities and transactions that occur under your account, whether authorized by you or not.
Wingo reserves the right to refuse registration, suspend, or terminate any account at its sole discretion, particularly where it suspects fraudulent activity, misrepresentation, or a violation of these Terms.
Wingo may require identity verification (KYC) before processing any prize disbursement exceeding LKR 10,000. Required documents may include a copy of your NIC, proof of address, and a recent bank statement.
Entry Fees & Payment
Participation in each challenge requires payment of a non-refundable entry fee of LKR 100 per entry per challenge. The entry fee must be paid in full prior to your participation being confirmed.
- Entry fees are processed through our supported payment gateways, which may include bank transfers, mobile payment apps, and other approved methods listed on the Platform.
- All transactions are conducted in Sri Lankan Rupees (LKR). Wingo does not currently support foreign currency transactions.
- Entry fees are non-refundable once a challenge has commenced, except as expressly provided in our Refund Policy.
- Wingo is not responsible for any fees, charges, or currency conversion costs imposed by your bank or payment provider.
- You must only use payment methods that are registered in your own name. Using another person's payment method without authorization is prohibited.
- Duplicate payments made in error will be refunded to the original payment method within 7 working days upon verification.
Prize Structure
Wingo operates on a fully transparent prize model. The total prize pool for each challenge is calculated as follows:
The prize pool grows proportionally with every new participant who enters the challenge.
The prize disbursement process is as follows:
- The winner(s) of each challenge will be determined according to the specific rules posted for that challenge.
- Prizes will be disbursed to the winner's registered bank account or digital wallet within 5–7 working days following the conclusion of the challenge.
- Wingo reserves the right to withhold prize payment pending identity verification (KYC) completion. If KYC is not completed within 14 days of prize notification, the prize may be forfeited.
- All prize winnings may be subject to applicable taxes under the laws of Sri Lanka, including Income Tax as stipulated by the Inland Revenue Act. You are solely responsible for reporting and paying all taxes applicable to your winnings.
- In the event of a dispute regarding the winner determination, Wingo's decision shall be final and binding.
- Wingo reserves the right to cancel a challenge and issue full refunds of entry fees if the minimum participant threshold is not met prior to the challenge commencement date.
Wingo does not guarantee that any specific prize amount will be achieved. The final prize pool is entirely dependent on the number of participants who enter the challenge.
Challenges & Rules
Each challenge posted on the Platform is governed by its own specific set of rules published at the time of listing. By entering a challenge, you agree to be bound by those rules in addition to these general Terms.
- Challenge details including the entry period, challenge requirements, judging criteria, and prize structure will be clearly stated on the challenge listing page.
- You are responsible for reading and understanding all rules applicable to a challenge before submitting your entry fee.
- Entries that do not comply with the published rules will be disqualified without refund.
- Wingo reserves the right to modify, postpone, or cancel any challenge at its discretion. In the event of cancellation, entry fees will be refunded in accordance with our Refund Policy.
- All challenge submissions must be your own original work, unless otherwise specified. Plagiarism, copying, or misrepresentation will result in immediate disqualification.
- Wingo's judges or automated systems will evaluate entries based on the published criteria. All judging decisions are final.
- In the event of a tie, the tiebreaker method specified in the challenge rules will apply. If no tiebreaker is specified, the prize may be split equally among tied winners.
Wingo is not responsible for any technical issues or failures on your end (internet connectivity, device malfunction) that prevent timely submission. Entries submitted after the deadline will not be considered under any circumstances.
Prohibited Conduct
The following actions are strictly prohibited and may result in immediate account termination, prize forfeiture, and potential legal action:
- Account fraud: Creating multiple accounts, using false identity information, or impersonating another person.
- Payment fraud: Using stolen, unauthorized, or fraudulent payment methods to pay entry fees.
- Collusion: Coordinating with other participants to gain an unfair advantage in any challenge.
- Manipulation: Using bots, scripts, automated tools, or any unauthorized software to interact with the Platform or gain an unfair advantage.
- Bug exploitation: Intentionally exploiting any technical vulnerability, glitch, or error in the Platform for personal gain.
- Abuse: Harassing, threatening, or abusing other users, Wingo staff, or any third parties connected to the Platform.
- Content violations: Submitting challenge entries that contain illegal, offensive, defamatory, sexually explicit, or otherwise objectionable content.
- Money laundering: Using the Platform to launder money or engage in any activity that violates anti-money laundering (AML) regulations.
- Unauthorized access:Attempting to access, modify, or interfere with the Platform's systems, databases, or another user's account.
Intellectual Property
All content on the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is the property of Wingo (Private) Limited and is protected by Sri Lankan and international copyright and intellectual property laws.
By submitting a challenge entry, you:
- Represent and warrant that you own or have the necessary rights, licenses, and permissions to submit the content.
- Grant Wingo a non-exclusive, royalty-free, worldwide, perpetual license to use, display, reproduce, and distribute your submission for Platform-related purposes, including promotional materials.
- Retain ownership of your original content; this license does not constitute a transfer of ownership.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content from the Platform without the prior written consent of Wingo.
The Wingo name, logo, and all related marks are registered trademarks of Wingo (Private) Limited. Unauthorized use of these marks is strictly prohibited.
Disclaimer of Warranties
The Platform and all content, materials, and services provided through it are offered on an "as is" and "as available" basis without any warranties of any kind, either express or implied.
- Wingo does not warrant that the Platform will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
- Wingo does not warrant the accuracy, completeness, or reliability of any content or information on the Platform.
- Wingo expressly disclaims all implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Participation in challenges involves inherent risk. Wingo does not guarantee that entry fees will result in prize winnings.
Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you in their entirety.
Limitation of Liability
To the fullest extent permitted by applicable law, Wingo, its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform.
In no event shall Wingo's total liability to you for all claims exceed the total amount of entry fees paid by you to Wingo in the twelve (12) months preceding the event giving rise to the claim.
- Wingo shall not be liable for loss of profits, loss of data, loss of goodwill, or service interruptions.
- Wingo shall not be liable for any unauthorized access to or alteration of your account data.
- Wingo shall not be liable for any third-party conduct, including payment processor failures or delays.
- Wingo shall not be liable for any force majeure events including natural disasters, government actions, telecommunication failures, or acts of war.
Indemnification
You agree to indemnify, defend, and hold harmless Wingo (Private) Limited and its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to:
- Your violation of these Terms or any applicable law or regulation.
- Your submission of challenge entries or other content to the Platform.
- Your use or misuse of the Platform.
- Your infringement of any third-party rights, including intellectual property rights.
- Any fraudulent, negligent, or otherwise improper conduct by you.
Wingo reserves the right, at your expense, to assume exclusive defense and control of any matter subject to indemnification by you.
Account Termination
Either you or Wingo may terminate your account at any time. Upon termination:
- Your right to access the Platform ceases immediately.
- Any pending entries in active challenges will be voided. Entry fees for voided entries will be refunded only if the challenge has not yet commenced.
- Any verified, unpaid prize winnings at the time of termination will be processed within 30 days, subject to identity verification and compliance with these Terms.
- Wingo may pursue legal action for any outstanding obligations or damages caused by your breach of these Terms.
Wingo reserves the right to terminate or suspend any account without prior notice if it determines, in its sole discretion, that you have violated these Terms, engaged in fraudulent activity, or posed a risk to the Platform or other users.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka, without regard to its conflict of law provisions.
Specifically, these Terms are subject to the following Sri Lankan legislation where applicable:
- The Companies Act No. 7 of 2007
- The Consumer Affairs Authority Act No. 9 of 2003
- The Electronic Transactions Act No. 19 of 2006
- The Payment and Settlement Systems Act No. 28 of 2005
- The Inland Revenue Act No. 24 of 2017 (as amended)
- The Personal Data Protection Act No. 9 of 2022
- The Computer Crimes Act No. 24 of 2007
Any legal proceedings arising from or related to these Terms shall be subject to the exclusive jurisdiction of the competent courts in Colombo, Sri Lanka.
Amendments
Wingo reserves the right to modify, update, or replace these Terms at any time at its sole discretion. When material changes are made, Wingo will:
- Update the "Last Updated" date at the top of this page.
- Send a notification to your registered email address at least 7 days before the changes take effect (for material changes).
- Display a prominent notice on the Platform.
Your continued use of the Platform after the effective date of any amendments constitutes your acceptance of the new Terms. If you do not agree to the revised Terms, you must cease using the Platform.
It is your responsibility to review these Terms periodically. Wingo encourages you to check this page regularly to stay informed of any updates.
